These Terms of Service (the “Terms”) govern your access to and use of mcanixsolutions.com (the “Site”), our free interactive tools, our published resources and playbooks, and any other materials we make available through the Site (together, the “Services”).
The Site is operated by MCANIX(“MCANIX,” “we,” “us,” or “our”), a marketing agency and custom software studio headquartered in Dallas–Fort Worth, Texas.
Please read these Terms carefully. They contain important information about your rights, our limits of liability, and how disputes are handled.
1. Agreement to Terms
By accessing or using the Site or any of the Services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated here by reference.
If you do not agree to these Terms, do not access or use the Site or the Services.
You represent that you are at least 18 years old, or otherwise of legal age to enter into a binding agreement in your jurisdiction, and that you have the authority to agree to these Terms on behalf of yourself or any organization you represent.
2. Description of Services
MCANIX provides the following through the Site:
- Marketing services: digital marketing services for hands-on industries, including SEO, paid lead engines, website systems, reputation management, social and content production, marketing automation, and generative engine optimization (GEO/AI SEO).
- Custom software development: estimating platforms, job management systems, customer portals, field service applications, and related tools built for trade businesses.
- Free tools and resources: including the Marketing Health Score, the Cost Per Lead Calculator, teardowns, playbooks, blog posts, and other published guides.
Free tools and resources are informational only
Our free tools and resources are provided on an as-is basis for general informational purposes. Outputs are based on your self-reported inputs, industry-average benchmarks, and the assumptions described in the tools or articles themselves. They are estimates, not guarantees of actual marketing performance. See Section 5 for the full disclaimer.
Paid services are governed by separate agreements
These Terms govern your use of the Site and our free Services. Any paid engagement between you and MCANIX — including pricing, scope of work, deliverables, payment terms, intellectual property assignments, and confidentiality — is governed by a separate, signed client agreement. Where these Terms and a signed client agreement conflict, the signed client agreement controls for the matters it covers.
3. Use of Website and Tools
You may use the Site and our free tools for lawful, personal, and internal business purposes. You agree that you will not:
- Use the Site or Services in violation of any applicable law, regulation, or third-party right.
- Scrape, harvest, mass-download, or systematically copy our content, tools, calculators, playbooks, or any other materials without our prior written permission.
- Reverse-engineer, decompile, or attempt to derive the source code of any tool or interactive element on the Site.
- Redistribute, sublicense, sell, or commercially exploit our content, tools, or playbooks without our prior written permission.
- Use our tools to generate misleading data, to fabricate results, or to misrepresent the outputs as anything other than estimates produced by self-reported inputs.
- Attempt to interfere with, disrupt, or compromise the security or operation of the Site, including by introducing malware, attempting unauthorized access, or sending automated traffic designed to degrade availability.
- Impersonate MCANIX, any MCANIX employee, or any other person or entity, or misrepresent your affiliation with MCANIX.
We may, at our discretion and without notice, restrict or terminate access to the Site or Services for users who violate these restrictions.
4. Intellectual Property
All content available through the Site — including but not limited to articles, playbooks, teardowns, guides, tools, calculators, source code, page designs, illustrations, copy, and the structure and organization of the Site — is owned by MCANIX or our licensors and is protected by copyright, trademark, and other intellectual property laws.
Limited license to use the Site
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and free tools for your personal or internal business purposes, subject to these Terms.
Sharing our articles and playbooks
You may quote, excerpt, or link to our blog posts, playbooks, and teardowns for non-commercial editorial or educational purposes, provided that you:
- Clearly attribute the content to MCANIX by name (e.g., “MCANIX” or “published by MCANIX”).
- Include a working link back to the original article on mcanixsolutions.com.
- Do not modify the content in a way that materially changes its meaning, attribution, or context.
- Do not republish the full text of an article in a way that substitutes for the original (excerpts and summaries are fine).
Tools may not be copied or embedded
Our interactive tools — including the Marketing Health Score and the Cost Per Lead Calculator — may not be copied, replicated, reverse-engineered, or embedded on third-party sites, in either their original or substantially similar form, without our prior written permission.
Trademarks
MCANIX, the MCANIX wordmark, the MCANIX color system, and any associated logos and visual identity elements are trademarks of MCANIX. All other trademarks, service marks, and trade names referenced on the Site are the property of their respective owners. Use of their marks does not imply any endorsement of or affiliation with MCANIX.
Feedback
If you send us feedback, suggestions, or ideas about the Site or Services, you grant MCANIX a perpetual, royalty-free license to use that feedback for any purpose, including improving the Services, without obligation to compensate or credit you.
5. Free Tools Disclaimer
The Marketing Health Score, Cost Per Lead Calculator, and any other free tools or calculators available on the Site (the “Tools”) are provided as a convenience for general informational purposes only.
Marketing Health Score
The Marketing Health Score generates a score and a set of recommendations based entirely on your self-reported answers to a multiple-choice quiz. The score is an estimate meant to highlight common gaps in trade-business marketing setups. It does not constitute an audit, a guarantee, or a certification of the actual state of your marketing.
Cost Per Lead Calculator
The Cost Per Lead Calculator computes cost-per-lead, cost-per-booked-job, and ROI figures using the spend, lead, and booked-job numbers you enter, the ticket size and margin you enter, and industry-average benchmarks from publicly available data. Outputs are illustrative and may not reflect the actual economics of your specific business.
Not professional advice
No output from any free Tool constitutes professional marketing, financial, legal, tax, or business advice. Actual marketing results vary widely based on market conditions, competitive dynamics, execution quality, season, offer, sales process, geography, and many other factors outside the Tools' scope.
You are responsible for any business decisions you make based on Tool outputs. MCANIX is not liable for any business, financial, or operational decisions made in reliance on a Tool result. Before acting on any output, consult with a qualified professional or contact us for a real, manual review.
Tool availability
We may modify, suspend, or discontinue any Tool at any time, with or without notice. We do not guarantee that Tools will be available continuously, error-free, or uninterrupted.
6. Third-Party Links
The Site may link to third-party websites, products, services, or resources — including but not limited to Google, Vercel, ServiceTitan, AccuLynx, Podium, Birdeye, NiceJob, and other tools we reference in our content. These links are provided for convenience and informational purposes only.
MCANIX does not control, endorse, sponsor, or assume any responsibility for the content, products, services, privacy practices, or policies of any third-party site or service. Your use of any third-party site is at your own risk and is governed by that site's own terms and privacy policy. We encourage you to review those terms before engaging with any third-party service.
7. Client Services
Submitting a contact form, requesting a free growth audit, or using one of our free Tools does not by itself create a client relationship, a service agreement, a commitment to perform paid work, or any other binding engagement between you and MCANIX.
Paid marketing services, software development engagements, and other paid work are governed by a separate written agreement executed between you (or your organization) and MCANIX. That agreement defines the scope, deliverables, timeline, pricing, payment terms, ownership of work product, confidentiality, warranties, indemnification, and other commercial terms specific to the engagement.
Nothing on the Site — including pricing ranges, methodology descriptions, case studies, sample budgets, or expected outcomes published in our blog posts, playbooks, or teardowns — constitutes an offer, a quote, or a commitment to deliver work at a specific price or on a specific schedule.
8. Limitation of Liability
Disclaimer of warranties. The Site, the free Tools, and all content and resources made available through them are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of content. MCANIX does not warrant that the Site or Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
Limitation of liability. To the maximum extent permitted by applicable law, MCANIX and its officers, employees, contractors, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including but not limited to lost profits, lost revenue, lost data, business interruption, or loss of goodwill — arising out of or related to your use of the Site, the Tools, or any content or resource, even if MCANIX has been advised of the possibility of such damages.
Cap on direct damages. MCANIX's total aggregate liability to you arising out of or related to these Terms, the Site, or the free Services shall not exceed the greater of (a) the total amount you have paid MCANIX, if any, in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100).
For paid client engagements, additional or different liability terms may apply as set forth in the separate signed client agreement governing that engagement.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In those jurisdictions, the above limitations apply to the maximum extent permitted by law.
9. Indemnification
You agree to defend, indemnify, and hold harmless MCANIX and its officers, employees, contractors, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including reasonable attorneys' fees) arising from or related to:
- Your use or misuse of the Site, the Tools, or our content.
- Your violation of these Terms.
- Your violation of any third-party right, including any intellectual property, privacy, or proprietary right.
- Any business or operational decision you make based on the output of a free Tool or content published on the Site.
We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense.
10. Governing Law
These Terms, and any dispute arising out of or related to them, the Site, or the free Services, will be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law principles.
You agree that any legal action or proceeding arising out of or related to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Dallas County, Texas, and you consent to the personal jurisdiction of those courts.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
11. Modifications
We may update, modify, or replace these Terms from time to time to reflect changes in our Services, in our practices, or in applicable law. When we do, we will update the “Last updated” date at the top of this page. For material changes, we may also post a notice on the homepage of the Site.
Your continued use of the Site or Services after a change to these Terms becomes effective constitutes your acceptance of the updated Terms. If you do not agree with the updated Terms, you should stop using the Site and Services.
